General terms and conditions of rental

In the event of non-performance by the lessee of an obligation incumbent upon him/her, in particular failure to return the equipment or to pay on the due date, the contract may be terminated by the lessor by operation of law to the detriment of the lessee 48 hours after formal notice has been given by registered letter which has remained unsuccessful. The lessor will then demand the immediate return of the equipment, without prejudice to the sums due for the rental period that has expired, under penalty of the sanctions provided for in article 12, or the application of a daily indemnity equal to the daily rent, and of a complaint under article 314-1 of the French penal code. In any event, the lessee remains responsible for the equipment and becomes its custodian within the meaning of Art 1915 C Civ. He has no right to use or dispose of it. In the event of early termination of a contract with a fixed price based on an incompressible rental period, the lessor will receive compensation equal to the total remaining rental or will revise the price initially indicated based on the actual rental period, whichever is less onerous for the lessee.
